These Terms of Service ("Terms") govern your use of the Happy Hour App website at fivehappyhour.com and related services (the "Service") operated by Happy Hour App ("we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is a platform for discovering happy hour deals at restaurants and bars. We provide information submitted by restaurant owners, our team, and user recommendations. We do not operate any restaurants or bars listed on the Service.
You may browse the Service without creating an account. To use features such as favourites, notifications, and the 'going' feature, you must create an account.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating your account.
Restaurant owners may claim or create listings on the Service. By submitting a listing, you represent that you are authorised to act on behalf of the restaurant and that the information you provide is accurate.
All listings are subject to admin approval before going live. We reserve the right to reject, modify, or remove any listing at our discretion.
We strive to ensure that happy hour information on the Service is accurate and up to date. However, we do not guarantee the accuracy, completeness, or currency of any deal, price, schedule, or other information displayed.
Deals and schedules are subject to change by restaurants at any time without notice to us. Always confirm details directly with the restaurant before visiting.
We are not liable for any loss or inconvenience resulting from inaccurate or outdated information on the Service.

The Service and its original content (excluding user-submitted content) are owned by Happy Hour App and protected by Canadian and international intellectual property laws.
Restaurant owners retain ownership of content they submit (photos, descriptions, logos) and grant us a non-exclusive, worldwide, royalty-free licence to display it on the Service.
Users who submit recommendations grant us a licence to use the submitted information to create and maintain listings on the Service.
To the maximum extent permitted by law, Happy Hour App shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.
This limitation applies whether the claim is based on contract, tort, negligence, strict liability, or any other legal theory.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.
You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
